DEFINITIONS

• “Customer”, “you”, “your” and “yourself” mean any individual, person or persons using or accessing the GSC’s Services and/or facility.

• “E-Combo” means any food and/or beverages sold and purchased via GSC E-Pay facility.

• “E-Kiosk” means GSC’s electronic ticketing kiosks located at designated GSC Box Offices.

• “E-Payment” and “GSC E-Pay” mean GSC's electronic ticketing facility and/or GSC’s online payment facility which enables the purchase of GSC services and/or products via the GSC Website, Mobile Application and/or E-Kiosk and shall also include such websites, applications, emails and other communications that link to or refer to E-Payment or GSC E-Pay.

• “FAQs” means the list of frequently asked questions concerning GSC’s Services posted and updated by GSC from time to time.

• “Force Majeure” means any acts of God, strikes, lock outs or other industrial disturbances, wars, insurrection, riots, landslides, earthquakes, storms, lightning, floods, civil disturbances, explosions, fire, effect of any measures or orders by any Government of Malaysia whereby movement of people is restricted or controlled or prohibited and/or suspension of certain services due to national emergency, outbreak of infectious diseases, epidemic, pandemic, quarantine, global health emergency and/or any other similar events not within the control of GSC.

• “GSC”, “we”, “us”, and “our” mean Golden Screen Cinemas Sdn Bhd (including all its subsidiaries, related and/or associated companies) in general.

• “GSC Cinema” refers to any of the GSC outlet(s) in Malaysia.

• “GSCoins” refers to the customer loyalty point system awarded to Members for the purchase of movie tickets, food and/or beverages and/or E-Combo via GSC Cinema or GSC E-Pay.

• “GSC Hall” refers to a GSC theatre room at any GSC Cinema.

• “Member” is a term used to address our patrons using the GSC Rewards program.

• “GSC Rewards” and “GSC Rewards Membership” mean GSC Rewards membership program.

• "Mobile App" means the GSC Mobile Application.

• “Services” means the provision of services, tickets, merchandise, concessions, vouchers, GSC Rewards, events and contests by GSC, including but not limited by way of the Website, Mobile App, E-Kiosk, Social Media, sale counters, concession stands, authorised third-party and/or other miscellaneous channels which may refer back to the Website or Mobile App.

• “Social Media” means the parts of social media operated by third parties through which GSC provides information, applications, promotions and/or other activities.

• "Terms" means the GSC’s Terms and Conditions.

• "Website" means our website at www.gsc.com.my or the mobile version thereof.

INTRODUCTION & ACCEPTANCE OF AGREEMENT
1. Welcome and thank you for choosing GSC. Please read these Terms carefully before accessing and/or using any of the Services.
2. By signing up or otherwise using any of the Services or accessing any of the content or material made available through the Service, you agree and acknowledge that you have read, understood and accepted these Terms (and any other additional terms which are referred herein) and you hereby agree to be legally bound by these Terms wherein such agreement shall constitute a binding contract between you and GSC. If you do not accept or are unable to comply with any of these Terms and/or additional terms, please do not use the Services or access any content associated with the Services.
3. GSC may, at its sole discretion and subject to the Terms contained below, change or vary the Terms from time to time on a prospective basis, as well as modify, add or discontinue any aspect, content or feature of the Services. Your continued usage or accessing of the Services following the posting of any changes to the Terms constitutes your express acknowledgement and acceptance of such changes to the Terms.
4. Any form of transfer or sublicense, or unauthorised access, distribution, reproduction, copying, retransmission, publication, sale or exploitation (commercial or otherwise) of any portion of the Services, including but not limited to all contents, services, digital products, tools or products, is hereby expressly prohibited.
5. Unless there is something in the subject or context inconsistent with such construction or unless it is otherwise expressly provided: -

(a) words denoting one gender include all other genders and words denoting the singular include the plural and vice versa;

(b) any reference to a statutory provision includes any modification, consolidation or re-enactment thereof for the time being in force and all statutory instruments or orders made pursuant thereto;

(c) if any period of time is specified from a given day, or the day of a given act or event, it is to be calculated exclusive of that day and if any period of time falls on a day which is not a Business Day, then that period is to be deemed to only expire on the next Business Day; and

(d) a reference in these Terms to “including”, “include” and other similar expressions shall not be construed restrictively but shall mean “including without prejudice to the generality of the foregoing” and “including, but without limitation”.

1. The headings are inserted merely for convenience of reference and shall be ignored in the interpretation and construction of any of the provisions herein contained.
PURCHASING & PAYMENTS
1. Tickets
  1. The FAQs on our website here contains further details on how to purchase tickets from us and you are strongly advised to read the FAQs prior to placing your order.
  2. All sales are subject to the availability of tickets and GSC retains the discretion to refuse your order should the Terms contained herein not be complied with.
  3. Upon successful processing of your purchase, you will be issued with either a physical ticket, or an e-ticket, QR Code or a self-print ticket for any purchase from Website or Mobile App, all of which shall be accepted by GSC to allow you entry into the authorised area of our GSC Halls subject always to GSC’s ultimate discretion.
  4. GSC shall only accept tickets which are issued or distributed directly by GSC or its authorised distributors, partners or agents. GSC reserves the right to refuse you entry for ticket(s) which have been obtained from any unauthorised source.
  5. Please read your online, email and/or mobile confirmation pages from GSC carefully, as they provide you with important information about retrieving your tickets that may be unique to your chosen GSC Hall. For the purchase of any e-ticket, including self-print ticket or QR Code Ticket, you shall present the same using your mobile device at the entrance of your chosen GSC Cinema.
  6. GSC reserves the right to refuse any issuance of ticket(s) if the identification document is not presented to GSC staff or does not match the purchase confirmation or details.
  7. There is no reserved seating unless it is specifically stated on your ticket.
  8. You represent and warrant that your ticket(s) are for personal use only, and that they are not purchased as part of any form of business or commercial activity, unless we have expressly authorised otherwise in writing. You also undertake to us that you will not: -
    (a) resell or offer for resale any tickets (whether at a premium or otherwise); and/or
    (b) use tickets for advertising or promotions (including give-aways, prize draws, competitions, contests and/or sweepstakes) or for any other trade purposes without the express written consent or permission of GSC. GSC reserves the right to invalidate any ticket which is found to be in breach of these Terms.
  9. You are required to keep your ticket safely with you while at GSC Hall at all times. GSC reserves the right to request and inspect your ticket at the GSC Hall at any time, failing which you may be required to leave the GSC Hall.
  10. In the event you are purchasing a movie ticket under one of the special categories of “student”, “senior citizen” or “disabled persons” registered with the Social Welfare Department”, you are required to present the relevant identification document(s), including your student ID/identity card/driver’s license/OKU card, whichever shall be applicable, in person at the applicable GSC Cinema in order to enjoy the benefits afforded to your respective category.
  11. For any purchase of ticket with an age restriction, you are required to present your identity card/driver’s license in person as evidence of your age at the applicable GSC Cinema.
  12. GSC reserves the right to request and inspect the identification document(s) of any movie ticket holder prior to entry into the GSC Hall and at all times within the premise of GSC Cinema.
  13. GSC reserves its right to change the prices and the showing times from time to time and shall be not held liable for any loss, damage, costs or expenses resulting therefrom.
  14. To ensure that everyone is able to enjoy GSC’s Services, GSC retains its absolute discretion to limit the quantity of movie tickets which may be purchased at any one time as well as the reservation of seats in GSC Halls.
  15. In the event of any dispute arising from the purchase of tickets, GSC shall retain the right to make a final decision on such dispute.
2. Vouchers & Hall Bookings

3. Food and Beverages & E-Combo
  1. All sales of food and beverages and E-Combo are subject to availability and GSC retains the discretion to refuse your order.
  2. For the redemption and collection of any food, beverage and/or E-Combo item, you are required to produce the valid proof of your purchase and/or redemption document (including a receipt of purchase, voucher, confirmation ID, physical ticket and/or e-ticket) issued or distributed directly by GSC, its authorised distributors, partners or agents at the concession stand of the respective GSC Cinema, failing which GSC may refuse your redemption or collection.
  3. All food, beverages and E-Combo items are only valid for redemption at the location of GSC Cinema and on the date specified in your booking confirmation. Any early or late redemption will not be entertained. Please read your online, email and/or mobile confirmation pages from GSC carefully for more information.
  4. In the event any food, beverage and/or E-Combo item you have purchased is unavailable at the point of redemption, GSC has the discretion but not the duty or obligation to offer you the choice of a substitute product (up to the value of item(s) you had purchased) or to offer you a full refund.
  5. Save and except for any error attributable to GSC and brought to the immediate attention of a GSC Cinema concession representative at the point of collection, all food, beverages and E-Combo are strictly not exchangeable or refundable upon purchase. You are therefore required to inspect all purchased items at the point of your collection.
4. Merchandise
  1. All sales of merchandises are subject to availability and GSC bears no obligation to provide any refund, exchange, replacement, return and/or cancellation after a transaction has been confirmed, save and except for any error attributable to GSC and brought to the immediate attention of a GSC staff at the point of collection. You are therefore required to inspect all purchased items at the point of your collection.
5. Online Transactions/GSC E-Pay
  1. The FAQs on our website contain further details on the registration and usage of GSC E-Pay.
  2. You are required to register an account with GSC via the Website and/or Mobile App with your requisite details prior to you being able to access online transactions and/or GSC E-Pay.
  3. GSC reserves the right to impose booking fees, service charges, taxes and/or surcharges for each successful transaction wherein the details thereof will be displayed prior to your confirmation of the said transaction. You may choose not to proceed with the said transaction without penalty any time before confirmation of the same.
  4. All transactions made through the Website and/or Mobile App shall only be accepted and be binding on GSC upon GSC’s approval of the transaction. You shall receive confirmation of your transaction via email or via your account in the Website and/or Mobile App.
6. Refund, Replacement & Return Policy
  1. It is and shall remain your responsibility to ensure the accuracy of the details of your purchase of tickets, food and beverages (including E-Combo items) and merchandises, GSCoins balance and reward voucher(s) redeemed. GSC bears no obligation to provide any refund, exchange, replacement, return and/or cancellation after a transaction has been confirmed.
  2. GSC has the sole discretion but not the duty or obligation to allow the exchange of any merchandise and/or to provide a refund, provided that:
    1. the exchange or return and refund request results from any error attributable to GSC and is brought to the attention of any GSC Cinema at the point of collection;

1. 1. 1. the exchange or return and refund request is accompanied with the original payment receipt; and
    2. all tags and accessories of such merchandise to be exchanged or returned, if any, shall remain intact
ADMISSION
1. The bearer of a ticket (including an e-ticket) entitles him or her to a one-time access to the screening of a movie at the GSC Hall in the GSC Cinema at the time and on the date as stated on the said ticket. As your admission to watch a movie is dependent on the information of your ticket (inclusive of an e-ticket), please do keep your ticket safely at all times.
2. You are required to take notice of the classification and/or any age restriction of the movie before you purchase any ticket from GSC. We are required by law and shall refuse admission to anyone who is below the minimum age as required under the relevant classification of the Film Censorship Board of Malaysia (Lembaga Penapisan Filem) and/or by the requirements of any authority (if any) to a movie/film performance.
3. We reserve the right to require your production of necessary documents as proof of your identity, age, status as a student, senior citizen or a disabled person (whichever is applicable) as and when deemed necessary.
4. Children between the age of three (3) and twelve (12) years are required to possesses their own individual valid ticket for entry and must be accompanied at all times by an individual who is at least 18 years of age in possession of his/her own valid ticket for entry.
5. Infant under the age of three (3) may be admitted without requiring a ticket, provided that: -
  1. such infant is accompanied by an individual who is at least 18 years of age and possesses a valid ticket for entry;
  2. the infant is only allowed to sit on the same seat as the one belonging to the accompanying individual;
  3. the screening is classified as U or P12; and
  4. that the infant must be immediately removed from the screening hall in the event the infant causes disturbance to others.
6. GSC reserves the absolute right and discretion to refuse your admission into its GSC Cinema or GSC Hall or to remove you from GSC Cinema or GSC Hall, including the use of reasonable force as may be necessary, without the obligation to provide any refund, in the event of any of the following circumstances, of which the list below is not intended to be exhaustive:-
  1. in the event you do not possess a valid ticket for entry into the GSC Cinema or GSC Hall or where you have entered GSC Cinema or GSC Hall in abuse of your valid entry; or
  2. you do not meet the relevant laws, rules, regulations, standard operating procedures and/or guidelines issued by the Government and/or necessary requirements of GSC for entry into GSC Cinemas or GSC Halls, including but not limited to grounds relating to safety, age or health; or
  3. you cause disturbance, annoyance, threat or damage to GSC and/or other persons within the premises of GSC; or
  4. you present a safety or health risk to yourself or other persons within GSC Cinema or GSC Hall; or
  5. you are found smoking and/or vaping within GSC Cinema or GSC Hall; or
  6. you are in possession of any prohibited items within GSC Cinema or GSC Hall, including but not limited to items which may endanger the safety of GSC Cinema or GSC Hall and/or other individuals or other items deemed inappropriate by GSC; or
  7. you attempt to bring an animal of any kind into GSC Cinema or GSC Hall or are in possession of animal of any kind within GSC Cinema or GSC Hall; or
  8. you are found to be in possession of food or beverage which are not purchased from GSC’s concession stand; or
  9. you are in breach of these Terms or any other of the terms and conditions which may be imposed by GSC.
7. GSC retains the right and discretion to conduct a search on your personal belongings upon your entry into GSC Cinema or GSC Hall.
8. Any photography or recording of content shown or broadcasted by GSC at any of GSC Cinema or GSC Hall is strictly prohibited, regardless of the purpose and usage of such recordings. GSC reserves its rights to take all necessary steps against you in the event you are found to be recording within GSC Cinema or GSC Hall, including but not limited to:-
  1. applying reasonable force to detain and/or prevent you from leaving GSC Cinema or GSC Hall;
  2. lodging a police report and to co-operate with the police in any investigation process against you;
  3. withholding any of your personal belongings which may be evidence of such recordings including but not limited to your electronic devices such as cameras, tape recorders, mobile phones and/or tablets; and/or
  4. to resort to all available legal avenues against you, including criminal prosecution.
9. It shall remain your sole responsibility to ensure the safety and safekeeping of your personal belongings and GSC shall not be held responsible for any loss or damage of the same for whatsoever reason.
10. You are put on notice that GSC has placed closed circuit televisions (CCTV) at/around its premises for the purposes of security and public safety. Such CCTV footages/recordings remain the private property of GSC and shall not be made available or accessible for public viewing or review save and unless where required to be disclosed by operation of law.
AMENITIES IN AURUM THEATRE & VELVET CINEMAS
1. Aurum Theatre & Velvet Cinemas is committed to providing a premium or luxurious movie-going experience, offering our guests access to a range of premium amenities designed to enhance comfort and enjoyment. These amenities are for use exclusively within the theatre premises during your visit.
2. Use of Amenities- we offer an array of in-theatre comforts including, but not limited to, seating, audio-visual equipment, blankets, pillows, sheets, slippers, refreshments, and wireless chargers. These items are carefully chosen to enhance your viewing experience and are intended for use only while you are our guest.
3. Policy on Blankets, Pillows, Sheets, and Wireless Chargers- the blankets, pillows, sheets, and wireless chargers provided are for your comfort during the film and must remain on the premises for the comfort of our next patrons. Blankets are available for purchase through Keepsake for personal use.
4. Slippers and Mini Fridge Items at Aurum Theatre - in recognition of our guests' preferences, slippers provided during your visit, along with any items from the mini fridge, are yours to keep should you choose to do so. We hope these keepsakes remind you of your exceptional experience with us at Aurum Theatre.
5. Refreshments and Dining Amenities- refreshments are included in the price of your ticket. However, cutlery, plating, and other dining amenities are the properties of GSC, Aurum Theatre and Velvet Cinemas. We strive to ensure every aspect of your visit is memorable, including our dining experience.
6. Guest Responsibility- guests are responsible for using all amenities with care and respect. Intentional damage or removal of Aurum Theatre property, including wireless chargers, is subject to penalties, including charges for repair or replacement.

TERMS OF USE
1. Usage of Services
  1. In your usage and/or access of the Services, you shall undertake not to:-
    1. exploit any materials belonging to GSC, whether commercial or otherwise;
    2. establish a direct link to the Website, Mobile App or Social Media without our express prior written consent;
    3. use the Website, Mobile App, E-Kiosk or Social Media to upload, comment or distribute any malicious content;
    4. infringe the rights of any other person;
    5. do anything that will or may interfere with, disrupt, damage or impair the Website, Mobile App, E-Kiosk, Social Media or our provision of Services;
    6. submit any information to the Website, Mobile App, E-Kiosk or Social Media which is defamatory, obscene, offensive, liable to cause harassment or distress, which does not comply with any law and/or consists of spam commercial offers or adverts; or
    7. infringe GSC's rights in the Website, Mobile App, E-Kiosks or Social Media.
  2. You shall not frame or use framing techniques to enclose any material on the Website, Mobile App, Social Media or any part of it without our express prior written approval. You shall not use any meta tags or other hidden text using the trademarks or trade names of GSC without the express prior written consent of GSC.
  3. You are prohibited from de-compiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on the Website, Mobile App, E-Kiosk or Social Media into a readable form. You are prohibited from circumventing or attempting to circumvent any of our security safeguards or those of our suppliers.
  4. If you ask us to send you information emails, your use of the content received through our information email service will be subject to these Terms as if that content formed part of the Website, Mobile App, Social Media and/or their materials.
  5. If you submit any comments or materials to the Website, Mobile App or Social Media, you assign all rights (including intellectual property rights) you may have in them to GSC, and we may use, reproduce, adapt, broadcast, copy, disclose, license, publish, sell, transmit and/or otherwise exploit such materials consistent with rights of ownership in any form and media on royalty-free and worldwide basis. You shall also waive and agree not to assert any proprietary, legal or moral rights in respect of such comments or materials.
  6. GSC has the absolute right to remove any material posted on the Website, Mobile App, or Social Media which are in our sole discretion in violation of the Terms or our guidelines and policies.
  7. GSC also reserves the sole and ultimate right to reject, ban or bar any person, who has violated the Terms or our guidelines and policies, from using, accessing, communicating and/or posting on the Website, Mobile App, or Social Media.
2. User Accounts
  1. Your usage of the Website, Mobile App and/or other functionality of the Services shall require your registration of an account with us.
  2. The user accounts issued and promoted by GSC and all copyright, trademarks and all other intellectual property rights in and in relation to the same shall at all times remain as the property of GSC or its licensors.
  3. All usage of and access to the user account is subject to availability, restrictions and other terms and conditions which GSC may impose from time to time. GSC reserves the ultimate discretion to determine any disputes or disagreements which may arise in respect of the user account.
  4. GSC reserves the right to request for and store your personal details where reasonably necessary to comply with these Terms or where required by any applicable law, regulation, court order or instruction or guidance of a competent regulatory authority.
  5. You are solely responsible for maintaining the confidentiality and shall not disclose it to any third party of your account information, including but not limited to your username, user identification code, password, security question and answer, verification number, personal details or any other piece of security information used as part of our security procedures. You are also solely responsible for any transaction or activity that occurs under your account, regardless as to whether such transaction or activity was made with or without your knowledge or authority.
  6. GSC shall not be liable to you for any special, indirect or consequential losses incurred by you in any way resulting from:-
    1. the use or access or the inability to use or access your account or any benefit and/or reward thereof;
    2. the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered via the use of and/or access to your account;
    3. unauthorised use, access to or alteration of your account’s data or information; or
    4. any other matters relating to your account, including but not limited to any cancellation, suspension, postponement or termination of your account by GSC.
  7. You shall report to GSC immediately if you became aware or suspect that the security of your account information may have been compromised or used by any third party without authority.
  8. You hereby agree to provide us with accurate information as required by the registration process and will update the information in the event of any changes in your personal information.
  9. We have the right to disable any user account and/or registration with us at any time if in our opinion you have failed to comply with your obligation to keep your security information secure and/or in the event of any unauthorised use of the user account.
3. User Content
  1. GSC has the right but not the obligation to monitor and/or control the information and/or contents submitted by other party on the Website, Mobile App or Social Media and GSC accepts no responsibility and liability for the contents of any such content. The information and/or content expressed on the Website, Mobile App or Social Media by any third party(ies) do not reflect GSC’s views and/or opinions and GSC shall not be held responsible for the accuracy or veracity of any statement, claim, opinion and/or review made by any third party(ies).
  2. If you are dissatisfied or unhappy about any content on any of the platform, you may provide feedback to us via our "Contact Us" page on the Website or Mobile App or by way of the information as described in paragraph 16 below.
4. Social Media
  1. The social media provider may choose to display advertisements and features alongside the Social Media. GSC has no control over the content or images in such advertisements and features. GSC does not endorse these adverts or features and accepts no responsibility for them.
  2. Social Media are provided via third party social media sites which have their own functionality, terms and privacy policies. You should be aware that these functions are part of the social media site, subject to the social media site’s respective terms and privacy policy. Please ensure you have read the terms and privacy policy of the social media sites carefully and have checked your personal settings to ensure you consent with how your information will be used by the social media site. Social Media may make use of these functions but GSC does not control nor exert any influence over them and shall not be responsible for any of the actions and/or omissions of the social media site.
5. Use Of Hyperlink
  1. You shall not link or frame this site without the prior written permission of GSC. Neither GSC, nor any of our affiliates, agencies and partners is responsible for the content of any other website, including any website through which you may have gained access from/to our Website, Mobile App or Social Media. We do not accept any liability in connection with any such sites or links.
GSC REWARDS
1. GSC Rewards Membership Program
  1. The “GSC Rewards FAQs” page here contains information on the registration, usage, operation, benefits and redemption of GSC Rewards program and you are required to read those FAQs before you sign up for GSC Rewards.
  2. GSC reserves the right to request for and store your personal details where reasonably necessary to comply with these Terms or where required by any applicable law, regulation, court order or instruction or guidance of a competent regulatory authority.
  3. All GSC Rewards issued and promoted by GSC remains the property of GSC at all times. All copyright, trademarks and all other intellectual property rights in and in relation to GSC Rewards shall at all times remain as the property of GSC or its licensors.
  4. All usage of and access to GSC Rewards is subject to availability, restrictions and other terms and conditions which GSC may impose from time to time. GSC reserves the ultimate discretion to determine any disputes or disagreements which may arise in respect of GSC Rewards.
  5. Please review our “GSC Rewards Terms & Conditions” page, which shall form part of these Terms. By signing up for GSC Rewards or otherwise using or accessing any of the content or material made available through GSC Rewards, you agree and acknowledge that you have read, understood and accepted the Terms therein (and any other additional terms which are referred herein) and you hereby agree to be legally bound by the Terms therein wherein such agreement shall constitute a binding contract between you and GSC.
2. Eligibility
  1. To be eligible for GSC Rewards activation, the Customer must be at least 18 years old or above, have a valid email address, and a valid mobile number.
  2. The Customer shall provide all relevant accurate personal information to GSC and shall promptly update the same in the event of any changes in the personal information.
  3. At the sole discretion of GSC, Customers are entitled to register or activate the GSC Rewards for FREE from GSC via GSC Mobile App or Website.
  4. GSC reserves the right to request and inspect the necessary identification document(s) of any Member at the time of purchase of movie tickets at GSC Cinemas.
3. Term
  1. The GSC Rewards shall be valid from the date of the successful activation as GSC Rewards Member and shall not expire. The benefits and rewards under the GSC Rewards shall, at all material times, be subject to the Terms and Conditions which may be imposed at any time by GSC.
  2. The GSC Rewards, together with all benefits and rewards under the GSC Rewards, are strictly non-exchangeable and non-transferrable.
  3. All Customers are required to register or activate to GSC Rewards Member in order to purchase movie ticket(s), food and/or beverage(s) and/or E-Concession(s) via GSC E-Pay.
  4. Please refer to the GSC Rewards FAQs for further information with regards to the term and validity of the GSC Rewards.
4. Benefits & Rewards
  1. These Terms and the GSC Rewards FAQs with regards to the benefits and rewards under the GSC Rewards program shall be deemed correct at the time of publication on GSC’s Website, Mobile App, E-Kiosk or Social Media but are subject to alteration at GSC’s sole discretion without notice. You are advised to visit any of the GSC Cinemas or log on to GSC’s Website, Mobile App or Social Media for the latest and updated information.
  2. Subject to GSC’s sole discretion, only Members with valid GSC Rewards may enjoy the benefits and rewards herein.
  3. All transactions with GSC under the GSC Rewards program are subject to availability and GSC retains the ultimate discretion to refuse or withhold any benefits or rewards should any of the Terms contained herein not be complied with.
  4. GSC reserves the absolute right and discretion to modify or discontinue, temporarily or permanently, all or any part of the benefits and rewards under the GSC Rewards program without further notice.
5. GSCoins
  1. Members are entitled to earn or collect GSCoins by purchasing movie ticket(s), food and/or beverage(s) and/or E-Concession(s) via GSC E-Pay or by presenting and scanning the Member QR Code shown in the Mobile App/e-card directly from the Member’s mobile device at the time of purchase made at any GSC Cinemas, E-Kiosks and/or concession stands.5 GSCoins will be awarded for every RM1.00 spent (exclusive of booking fees for all types of movie tickets). Similarly, 1 GSCoin will be awarded for every RM0.20 spent.
  2. For clarity in terms of currency denomination, here are some examples:
    1. Spent RM0.19 and below = No earning of GSCoins
    2. Spent RM0.20 to RM0.39 = Earn 1 GSCoin
    3. Spent RM0.40 to RM0.59 = Earn 2 GSCoins
    4. Spent RM0.60 to RM0.79 = Earn 3 GSCoins
    5. Spent RM0.80 to RM0.99 = Earn 4 GSCoins

Based on the above understanding, the number of GSCoins earned is calculated as follows:

Spent RM0.99 = Earn 4 GSCoins
Spent RM40.25 = Earn 201 GSCoins

The total number of GSCoins earned for the purchase of more than one item in a single receipt shall be calculated by adding the number of GSCoins earned for each item purchased and NOT based on total receipt amount.

Example:

Item 1 : Popcorn RM10.75 = 53 GSCoins

Item 2 : Nugget RM6.75 = 33 GSCoins

1. 1. All GSCoins earned will be credited into the Member’s account within 24 hours after the date of movie or food and/or beverage or merchandise or E-Concession save and unless due to unforeseen circumstances.
  2. All accumulated GSCoins shall expire after 180 days from the date of last transaction as GSC Rewards Member via GSC E-Pay or at any GSC Cinemas, any Aurum Theatre, E-Kiosks and/or concession stands.
  3. All transactions made by GSC Rewards Members via Keepsake online (https://shop.gsc.com.my) are not entitled to the earning of GSCoins.
  4. All GSC Cinemas online food & beverage transactions made by GSC Rewards Members via the Self Ordering System (https://cso.gsc.com.my/CSO2/home) are not entitled to the earning of GSCoins.
  5. GSCoins will not be earned via the following action(s):
    1. Hall Booking;
    2. Events Booking;
    3. Special Screenings or Events;
    4. Bulk vouchers / tickets purchase from GSC Sales department;
    5. Any transaction that doesn’t incur any monetary value (RM0)
    6. Any transaction made through GSC Sales department;
    7. Booking fee;
    8. Any transaction made through Keepsake online (https://shop.gsc.com.my/); and/or
    9. Any transaction made through the Self Ordering System (https://cso.gsc.com.my/CSO2/home).
  6. Unless otherwise notified at the time of purchase, GSCoins cannot be earned or redeemed in conjunction with any other discount, offer or promotion. GSCoins collected cannot be sold, transferred or exchanged for cash. GSC maintains the sole discretion but not the duty or obligation to process and/or provide a refund of GSCoins once any redemption has been confirmed.
  7. GSC retains the ultimate discretion to void and/or reverse the associated GSCoins earned or redeemed if a transaction on which GSCoins are earned or redeemed is cancelled or reversed or when an item is returned.
  8. GSC reserves the right to refuse any collection of GSCoins following or subsequent to any purchase made at any GSC Cinemas, E-Kiosks and/or concession stands in the event the Member fails to present a Mobile App/e-card at the time of purchase.
  9. The Terms and Conditions in relation to the award of GSCoins are subject to revision, variation or amendment by GSC at any time without prior notice.

2. Rewards Voucher Exchange or Redemption
  1. Exchange of Rewards Vouchers using GSCoins will be based on a fixed redemption amount. Rewards Vouchers consist of Free Ticket Voucher and Food and Beverages Voucher. No partial redemption of movie tickets is allowed using GSCoins.
  2. Rewards Vouchers are valid for 180 days from the date the Member exchanges the GSCoins for a Rewards Voucher via GSC mobile app or GSC website.
  3. Only One (1) Rewards Voucher is valid for redemption within one (1) single transaction.
  4. Members are entitled to exchange their accumulated GSCoins for Food and Beverages Voucher(s) and redeem the same during the subsequent purchase of food and/or beverage in GSC or Aurum Theatre which GSC may determine from time to time.
  5. Members are entitled to exchange their accumulated GSCoins for Free Ticket Voucher(s) and redeem the same during the subsequent purchase of movie ticket in GSC or Aurum Theatre which GSC may determine from time to time.
  6. Redemption of Rewards Vouchers could be done via GSC E-Pay or by presenting and scanning the Member QR Code shown in the Mobile App/e-card directly from the Member’s mobile device at any GSC Cinemas, E-Kiosks and/or concession stands.
  7. The Rewards Vouchers cannot be transferred, exchanged or redeemed in cash.
  8. Unless otherwise specified at the time of purchase, the Rewards Vouchers cannot be used or applied in conjunction with any other discount, offer or promotion.
  9. Please refer to the GSC Rewards FAQs for further information with regards to the application of the Rewards Vouchers.
3. Events & Contests
  1. GSC reserves its absolute right in respect of all events, contests, exhibitions, competitions and/or campaigns in connection to the GSC Rewards.
  2. By participating in any such event, contest, exhibition, competition and/or campaign held by GSC, you agree that all materials submitted to GSC, including all ownership, copyrights and intellectual rights of such materials shall belong to GSC.
4. Events of Default & Termination of GSC Rewards
  1. GSC reserves the right to cancel or terminate your GSC Rewards without notice and for any reason notwithstanding that we may have waived our rights on some previous occasion upon the occurrence of the following non-exhaustive circumstances:-
    1. you do not meet the requirements which may be imposed by GSC from time to time; or
    2. you are or have engaged in any unusual, irregular, suspicious, abusive, fraudulent, unlawful or unauthorised use of GSC Rewards which are deemed to be detrimental to the interests of the GSC or its other members; or
    3. you are or have abused the benefits, awards, rewards or privileges of GSC Rewards; or
    4. you are in breach of the Terms contained herein or other terms which GSC has imposed.
  2. In the event of a cancellation or termination of your GSC Rewards under paragraph 7.2.1 above, GSC retains the absolute right and discretion to forthwith forfeit any benefits accrued from your GSC Rewards.
  3. GSC may terminate, suspend or make changes to GSC Rewards program without notice.
OWNERSHIP & INTELLECTUAL PROPERTY
1. The ownership of all contents relating to the Services including but not limited to documents, materials, texts, designs, graphics, pictures, videos, audio applications, equipment, data, products and intellectual property shall vest and remain vested with GSC (or its affiliates, licensors or licensees, whichever applicable), whereby such contents are protected by copyright, trademark and other intellectual property rights and law within and beyond Malaysia. These contents shall not be used, sold, reproduced, copied, modified, distributed, displayed, transmitted or otherwise exploited in any form by any means, in whole or in part, commercial or otherwise.
PRIVACY POLICY & PERSONAL DATA PROTECTION
1. Please review our privacy policy and personal data notice at here, which shall form part of these Terms. By using and/or accessing the Services, you understand, agree and consent to our collection, use and disclosure of your personal information at GSC’s discretion in accordance to our privacy policy.
DISCLAIMERS
1. You hereby understand and agree that the Services are provided to you on “as is where is” and “best-effort” basis without any express or implied warranty or condition of any kind. We do not make representations towards the accuracy, satisfactory quality, merchantability or fitness for a particular purpose or non-infringement.
2. While GSC makes its best effort to ensure all showings take place in accordance with the advertised program, GSC reserves the right to cancel, reschedule or substitute an alternative showing for whatever reason, with reasonable endeavours to notify you of the cancellation or rescheduling but we do not guarantee that you will be informed of such cancellation or rescheduling before the date/time of the screening.
3. The Website, Mobile App and Social Media are provided free of charge and we make no guarantee that they will be uninterrupted, complete, accurate and/or error-free. In addition, we reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Website, Mobile App and/or Social Media without notice and without liability.
4. GSC makes no representation nor does it warrant, endorse, guarantee, or assume responsibility for any third-party applications (or the content thereof), user content or any other product or service advertised, promoted or offered by a third party through or on the Website, Mobile App or Social Media and GSC is not responsible or liable for any transaction between you and third party providers of the foregoing.
5. While reasonable endeavours are used to ensure the accuracy of any information on and to exclude any malicious content from the Website, Mobile Apps and Social Media to the extent/level of control that we are given over them, but we make no representation or warranty of any kind that the Website, Mobile Apps or Social Media or any of their contents will be accurate, current, complete, error-free or free from viruses introduced by third parties. GSC is not responsible for the accuracy of user content or social media sites and shall not accept liability of any kind for any loss or damage arising from action taken in reliance on information on the Website, Mobile Apps or Social Media or caused by any malicious content therein.
LIABILITY
1. Nothing in these Terms shall operate to exclude or limit GSC's liability for death or personal injury caused by GSC's negligence, for fraud or fraudulent misrepresentation committed by GSC and/or their agents or for any other liability which may not be excluded or limited by law.
2. Without prejudice to the paragraph 10.1 above and the Terms contained herein,
  
  a)   GSC shall not be liable for any special, indirect or consequential losses incurred by you in any way. Any liability GSC has is restricted to reasonably foreseeable losses and/or damage;
  
  b)   GSC shall not be liable or responsible for any failure to perform or delay in any showing and/or performance or any of GSC’s respective obligations that are caused by events outside of GSC's reasonable control;
  
  c)   GSC shall not be liable for the non-performance or inadequate performance or delay to its obligations derived from these Terms caused by Force Majeure or any cause which not reasonably foreseeable or beyond GSC’s reasonable control;
  
  d)   where erroneous pricing information has been given to you, and the error is obvious and could reasonably have been recognised by you as erroneous, GSC shall not be obliged to supply the item at the erroneous price; and
  
  e)   GSC's total liability for all claims arising out of or in connection with the Services, if any, shall be limited to the price paid by you for those Services concerned.
SUSPENSION & TERMINATION
1. We reserve the right to investigate any suspected non-compliance of these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may take action to cease your usage of and/or access to the Services, including but not limited to:-
  1. immediately suspending or terminating your access to the Website, Mobile App and/or Social Media;
  2. immediately suspending or terminating any user account or GSC Rewards you have with us; and/or
  3. take such other action as we reasonably consider appropriate.
THIRD PARTY ADVERTISEMENTS & LINKS
1. We may occasionally permit third parties to use the Website, Mobile App and Social Media and/or our information/emails to promote their goods and/or services. This may include providing links on the Website, Mobile App and Social Media to third party websites, services and applications which are not controlled by GSC. Social Media may sit within a website or application provided by a third party. This does not mean that GSC endorses that third party, its website(s) or any of the services or products it offers. We are not agents for any such websites, advertisers or applications and we are not authorised to make representations on their behalf (unless expressly stated). GSC is not responsible for the privacy practices of any such website or application. You provide personal information to such websites and applications at your own risk and you are advised to check the privacy policies of any third-party concerned prior to using such websites and applications.
GOVERNING LAW
1. These Terms shall for all purposes be governed by and construction in accordance with the laws in Malaysia and the parties hereto hereby irrevocably agree to submit to the jurisdiction of the Courts of Malaysia.
INDEMNITY
1. You shall indemnify and keep indemnified GSC (and its associated companies, subsidiaries, officers, directors, employees, agents, successors and assigns) from and against all claims, liabilities, damages, losses and/or expenses of any kind arising out of or related to:-
  1. any breach of these Terms by you;
  2. your usage and/or access of the Website, Mobile App and E-Kiosk relating to the Services; and/or
  3. your violation of any law and/or rights of a third party.
MISCELLANEOUS
1. Scope of Agreement
  1. These Terms and any document expressly referred to in them represent the entire agreement between GSC and you in relation to their subject matter, in substitution for and shall supersede any and all previous agreements between you and GSC, whether made in writing or orally. To the extent permitted by law, all conditions and warranties implied by law, statute or otherwise are expressly excluded.
2. Modification of Terms
  1. GSC has full discretion to modify the Terms or other guidelines, policies and guidelines at any time. Any such modification will be published by any means, such as on the Website, Mobile App, Social Media and/or E-Kiosk. Unless stated otherwise, any change in the Terms shall take effect immediately. Your continued use of the Services after any change to the Terms shall constitute your acceptance to be bound by the revised Terms.
3. Waiver
  1. Knowledge or acquiescence by GSC of any breach of any of the Terms herein shall not operate as or be deemed to be as waiver of such Terms and GSC shall be entitled to exercise its rights and to require strict performance of the Terms herein.
4. Severability
  1. If any of these Terms shall be deemed invalid, illegal or unenforceable in any respect under any applicable law, the validity, legality and enforceability of the remaining terms contained herein shall not in any way be affected or impaired. The said invalid, illegal or unenforceable portion shall be deemed to be deleted from these Terms and these Terms shall remain in full force and effect as if such provisions had not originally been contained herein.
5. Communications
  1. Any notice or communication to GSC shall be in writing and delivered by way of:-
    1. By hand;
    2. e-mail to cs@gsc.com.my; or
    3. registered post to Golden Screen Cinemas Sdn Bhd:
      No. 1, Jalan SS22/19, Damansara Jaya, 47400 Petaling Jaya, Selangor Darul Ehsan.
  2. A notice is taken as received by GSC:-
    1. if by hand or by e-mail, then at the time of receipt of the notice; and
    2. if by registered post, seven (7) business days after posting; but if delivery or receipt is on a day which is not a Business Day or is after 5.00 p.m. at the place of delivery or receipt, it is taken as given at 9.00 a.m. on the next Business Day.
  3. All correspondences between the parties shall be in the English language.
6. Assignment
  1. GSC may assign any of its rights under these Terms, in whole or in part, and may delegate any of its obligations under these Terms. You shall not assign or transfer your rights under these Terms to any third party.
